Legal Structure and Payment Schedule

Completed in August 2008, The Park Samui is developed based on a condominium license; therefore, units can be sold as condominiums with direct foreign ownership. The transaction process of the sale/purchase is described as follows:

1.

After selected a condominium unit, the client shall sign the Reservation Agreement with TROPICULTURE; at the same time paying 10% of the unit price as the earnest deposit.

2.

Within 2 calendar months after the client has paid the deposit for a condominium unit, he/she shall pay 40% of the unit price and sign Sale & Purchase Contract and Residence Rules & Regulations with TROPICULTURE.

3.

Within 3 calendar months after signing Sale & Purchase Contract, the client shall pay a minimum of 30% of the unit price to TROPICULTURE.

4.

Within 1 calendar month after paying the third payment above, the client shall pay the last 20% of the unit price and TROPICULTURE shall transfer the condominium title to the client. Please note that it is possible if the client want to buy and transfer the unit at once.

Monthly Maintenance Fee

The monthly service fee is 5,500 THB for all A-type units and 6,000 THB for all B-type units and it will be adjusted annually based on the inflation rate announced by the Bank of Thailand. TROPICULTURE, the developer, will run the services & maintenance of the project. The fee will be collected in advance for a 6-month period each.

The services provided include swimming pool maintenance, once-a-week basic cleaning, gardening, garbage collection, communal lightings and 24-hour security.

Guaranteed Rental Return

The Park Samui is now able to offer its House Owners to join a Guaranteed Rental Return Program. The program will guarantee a yearly rental return of 6-8% depending on the occupancy rate. The program still allows the House Owner 28 nights usage per year, and is valid for 3 years, but can be cancelled at any time by the House Owner. The Guaranteed Rental Return together with gaining capital appreciation as owner of the property, makes investing in The Park Samui one of the safest investments in Koh Samui.
